TERMS OF SERVICE

OVERVIEW This website is operated by Figure Projects (based in Auckland, New Zealand). Throughout the site, the terms “we”, “us” and “our” refer to Figure Projects. By visiting our site or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

SECTION 1 - GENERAL CONDITIONS We reserve the right to refuse service to anyone for any reason at any time. Credit card information is always encrypted during transfer over networks.

SECTION 2 - NEW ZEALAND LAW & JURISDICTION These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Zealand. You and Figure Projects consent to the exclusive jurisdiction of the courts of New Zealand.

  • Accuracy: We have made every effort to display as accurately as possible the colors and images of our products. We cannot guarantee that your computer monitor's display of any color will be accurate.

  • Stock Availability: As we operate a distribution model with third-party partners, stock levels can fluctuate. In the rare event an ordered item is out of stock, we will contact you immediately to offer a full refund or a pre-order option.

  • Carriers: We utilize third-party freight partners (such as Mainfreight, Toll, and NZ Post) to deliver heavy items directly from our suppliers' warehouses to you.

  • Delays: While we strive to meet estimated delivery times, Figure Projects is not liable for shipping delays caused by the carrier or events outside our control.

  • Risk: Risk of loss and title for items purchased from this website pass to you upon delivery of the items to the carrier.

SECTION 6 - CONSUMER GUARANTEES ACT (CGA) Nothing in these terms is intended to limit your rights under the New Zealand Consumer Guarantees Act 1993. If you are acquiring goods for business purposes (e.g., equipping a commercial gym), you agree that the Consumer Guarantees Act does not apply.

SECTION 7 - LIMITATION OF LIABILITY (GYM EQUIPMENT)

  • Use of Equipment: You acknowledge that the use of gym equipment, saunas, and heavy machinery involves inherent risks. Figure Projects is not liable for any injury, damage, or loss resulting from the improper use, assembly, or maintenance of products purchased from us.

  • Damages: To the fullest extent permitted by law, Figure Projects shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind arising from your use of any of the service or any products procured using the service.
